Deep Journal — Terms of Service

These terms govern your use of the Deep Journal iOS and macOS apps ("the app"). By using the app, you agree to these terms. If you do not agree, please uninstall the app.


1. What the app is

Deep Journal is a personal journaling tool with optional AI-assisted reflection features. It is developed and distributed by Zian Meng as an independent developer.

Deep Journal's AI features are powered by third-party large language models (currently Google's Gemini). AI-generated summaries, reflections, patterns, and wellbeing estimates:

Your journal entries, photos, voice notes, and related data remain your own. The app does not acquire ownership or any license to your content. It stores and, at your request, transmits your content for processing as described in the Privacy Policy.

6. Subscriptions and payments

The app may offer paid features via Apple's In-App Purchase system. Payments are handled by Apple under Apple's terms. Subscriptions renew automatically unless canceled at least 24 hours before the end of the current period. You can cancel or manage subscriptions in your Apple ID settings.

7. Disclaimers

The app is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, express or implied, including but not limited to merchantability, fitness for a particular purpose, non-infringement, accuracy, or uninterrupted availability.

The developer makes no warranty that:

8. Limitation of liability

To the maximum extent permitted by applicable law, the developer shall not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages — including but not limited to loss of data, loss of profits, emotional distress, or harm arising from reliance on AI-generated content — even if advised of the possibility of such damages.

The developer's total liability arising out of or relating to these terms or the app is limited to the greater of (a) the amount you paid to the developer for the app in the twelve (12) months preceding the event giving rise to the claim, or (b) one U.S. dollar ($1.00).

Nothing in these terms excludes or limits liability that cannot be excluded or limited under applicable law (for example, certain consumer rights).

9. Indemnification

You agree to indemnify and hold harmless the developer from any claims, damages, or expenses (including reasonable attorneys' fees) arising out of your misuse of the app or your violation of these terms.

10. Termination

You may stop using the app at any time by uninstalling it. The developer may suspend or discontinue the app, in whole or in part, at any time, without notice.

11. Changes to these terms

If these terms change, the "Last updated" date above will be updated. Material changes will also be surfaced in the app. Continued use after a change constitutes acceptance.

12. Governing law

These terms are governed by the laws of the jurisdiction in which the developer resides, without regard to conflict-of-law rules. Any dispute that cannot be resolved informally will be brought in the competent courts of that jurisdiction, unless mandatory consumer-protection law in your jurisdiction provides otherwise.

13. Severability

If any provision of these terms is held unenforceable, the remaining provisions remain in full force and effect.
